  • In the event of aircraft being unserviceable, Air Global Aviation reserves the right to substitute aircraft as required.
  • Aircraft are subject to availability on day of departure Aircraft are confirmed as booked only after the return of a signed letter of confirmation, or by return of a signed copy of this confirmation document.
  • Any delays or changes of the charter by the customer will incur additional charges.
  • Flight times are approximate and are subject to traffic and weather.
  • Smoking is not permitted on any flights.
  • Passenger baggage is limited to small soft bags.
  • A 10% non-refundable deposit is payable on confirmation and the remaining balance to be paid 7 days prior to departure. 
  • Payments can be made by credit card,or direct deposit.
  • 100% cancellation fee will apply if a cancellation is received within 24 hours of the agreed scheduled departure time.
  • Credit card payments will incur a 3.5% surcharge.



A.    BINDING AGREEMENT:  This Charter Agreement (this "Agreement"), once "agreed to"  by you ("Customer") as indicated below,  and accepted by the air carrier ("Air Carrier") that will operate the subject charter flight(s) (the "Flights"), shall constitute a legally binding agreement between Customer and Air Carrier.  The term "Trip" means all  of the Flights to be operated for Customer under this Agreement.

B.     CHARTER SERVICE:  So long as Customer is in full compliance with this Agreement, Air Carrier will operate the Flights in accordance with, and subject to, the terms and conditions of this Agreement.  The Flights will be operated by Air Carrier to transport persons in accordance with the provisions of FAR Part 135.  Air Carrier's pilots shall be in command of the Aircraft at all times, shall be entitled to make all decisions regarding the boarding (or refusal to board) any passengers and the acceptance or rejection of any baggage on any Flight.

C.     PRICES AND PAYMENT TERMS:  Customer agrees to pay the Total Charge (defined below) for the Flights via bank credit card prior when this Agreement is "agreed to" by Customer, as more specifically provided below.   TIME IS OF THE ESSENCE IN THE PAYMENT OF ALL AMOUNTS DUE AND PAYABLE TO AIR CARRIER UNDER  THIS AGREEMENT.


(a)    Customer may cancel the Trip at any time prior to the initial Flight hereunder, subject, however,  to a cancellation charge of 50%  if Customer cancels within 72 hours of the scheduled departure of the initial Flight hereunder.  If Customer cancels a return Flight, Customer shall be responsible for the full cost of the Trip under this Agreement.

(b)   Air Carrier will return to Customer any money received for a Trip that is cancelled by Air Carrier for any reason  other than a cancellation by Customer or a breach of this Agreement by Customer.  Such refund shall be Customer's sole remedy in the event of such cancellation. 

E.     TRAVEL DOCUMENTS: Customer shall be solely responsible for ensuring that passengers have in their possession all required travel documents for all Flights, including passports and visas.  Customer shall cause all of the passengers to display their respective photographic identifications to Air Carrier or its pilot in command of the Aircraft prior to each Flight, and to comply with any other applicable security requirements and procedures.

F.     PASSENGER BEHAVIOR: Customer shall instruct and cause the passengers to act in a reasonable and professional manner while aboard the Aircraft and to comply with the directives and instructions of the pilots in command of the Aircraft.  Customer shall be liable to Air Carrier for any and all damage caused by any of the passengers to the Aircraft.

G.    LEGAL LIABILITY:  Air Carrier shall not be liable to Customer or any other person or entity for any injury to or death of any person or for any damage to or loss of any property unless such injury, death, damage or loss is the direct result of negligence or intentional misconduct on behalf of Air Carrier or any of its employees; provided, however, that (a) under no circumstances shall the liability of Air Carrier exceed the amount of insurance actually paid by Air Carrier's insurer in connection with such incident, and (b) under no circumstances shall Air Carrier be responsible for any lost profits or any special or consequential damages.

H.    JURISDICTION:  Each of the parties hereby submits to personal jurisdiction in the State of New South Wales in connection with any disputes or controversies arising under this Agreement or with the enforcement hereof.  If Air Carrier collects any amount due or payable hereunder from Customer by or through an attorney-at-law, Customer shall pay, upon demand, the reasonable attorneys' fees and costs incurred by Air Carrier in such effort.

I.      MISCELLANEOUS:  This Agreement (a) represents the entire agreement between the parties hereto with respect to the subject matter hereof, (b) shall be governed by and construed in accordance with the substantive laws of NSW, Australia; (c) may not be altered or amended except pursuant to a written agreement signed and delivered by the parties; (d) shall be binding upon and inure to the benefit of the parties hereto and their respective successors and permitted assigns, and (e) may be executed via facsimile and in multiple counterparts.  Customer may not assign this Agreement or any right hereunder to any other person or entity.

J,      AIR GLOBAL AVIATION.  Air Global Aviation, ("Air Global"), is the authorized marketing agent of Air Carrier.  Air Global is not (a) an air carrier, (b) an affiliate of Air Carrier, (c) providing any the air transportation that is the subject of this Agreement or operating the Aircraft, (d) liable or responsible to Customer or any other person or entity for any act or omission of Air Carrier or any of its employees or other agents or contractors, or (e) a party to this Agreement. 

K.    METHOD OF PAYMENT (subject to the express approval of Air Carrier): 
Credit Cards Accepted:  VISA, Master Card, American Express or Direct Deposit

Customer hereby accepts and agrees to the foregoing terms and conditions and agrees to abide by the same.  Customer agrees further that if it fails or refuses to pay, when due, any amount hereunder, Air Carrier  is hereby authorized to charge such amount to the Credit Card, without further action on the part of Customer. 

Air Carrier will inform Customer of it decision to accept or reject this Agreement via email within 48 hours of Customer's submission of this Agreement.  Air Carrier's failure to respond with such time shall constitute a rejection of this Agreement by Air Carrier. 

Air Carrier (either directly or through its agent, Air Global Aviation) will hold, in escrow, any funds received from Customer for a Trip until completion of the Trip or, if sooner, upon cancellation of the Trip (or the remaining part of any Trip) by Customer or Air Carrier, at which time such funds shall be applied to Customer's obligations to Air Carrier under this Agreement and/or refunded to Customer, as provided above.
